Landis presents on “Crossing the T’s and Dotting the I’s: Documenting the Settlement Agreement” at ABI Winter Leadership Conference

Partner Adam Landis recently participated in the panel “Crossing the T’s and Dotting the I’s: Documenting the Settlement Agreement” at the American Bankruptcy Institute’s Winter Leadership Conference.

The panel explored ways to draft pre-petition settlement agreements so that they are “bankruptcy- and preference-proof.” Post-petition settlements were addressed, with a focus on discussion of releases, further assurance clauses, indemnification issues, and the settlement of various types of contested matters and adversary proceedings such as claims objections and avoidance actions.

Moderated by Damian Schaible of Davis Polk in New York, the panel also included Joseph Frank of Frank Gecker in Chicago and Kimberly Posin of Latham & Watkins in Los Angeles.
