Landis Rath & Cobb, together with Knobbe, Martens, Olson & Bear, LLP, successfully represented ReCor Medical, Inc., a startup medical device company that acquired all of the assets of a bankrupt company, in an action in the Court of Chancery against the seller’s former chief executive officer and his new company for secretly misappropriating the company’s intellectual property in violation of his fiduciary and contractual duties. After a trial on the merits, the Court of Chancery found in favor of ReCor, and ordered the defendants to take appropriate steps to assign the intellectual property to ReCor and to pay ReCor’s attorneys’ fees and expenses. The Delaware Supreme Court subsequently affirmed the Vice Chancellor’s decision.
